This Personal Data Processing Policy is drawn up in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and sets out the procedure for processing personal data and the measures taken to ensure the security of personal data by Fornex Hosting S.L., Fornexcloud Ltd., FORNEX INC (hereinafter the "Controllers").
The Controller’s paramount goal and condition for carrying out its activities is to respect the rights and freedoms of every person when processing their personal data, including the protection of the rights to privacy and to personal and family confidentiality.
This Controller’s policy regarding the processing of personal data (hereinafter, the Policy) applies to all information that the Controller may obtain about visitors to the fornex.com website.
2. Basic concepts
Automated processing of personal data means the processing of personal data by means of computer technology;
Blocking of personal data means the temporary suspension of the processing of personal data (except where processing is necessary to rectify personal data);
Website means the collection of graphic and informational materials, as well as computer programs and databases, that make them available online at the address fornex.com;
Personal data information system means a set of personal data contained in databases, together with the information technologies and technical means that ensure their processing;
Anonymization of personal data means actions that make it impossible, without the use of additional information, to attribute personal data to a particular User or other data subject;
Processing of personal data means any action (operation) or set of actions (operations) performed with or without the use of automation on personal data, including collection, recording, systematization, accumulation, storage, rectification (updating, modification), retrieval, use, transfer (distribution, provision, access), anonymization, blocking, deletion, and destruction of personal data;
Controller means the natural or legal person that, alone or jointly with others, determines the purposes and means of the processing of personal data, as well as the composition of the personal data to be processed and the actions (operations) performed with personal data;
Personal data means any information relating directly or indirectly to an identified or identifiable User of the fornex.com website;
User means any visitor to the fornex.com website;
Provision of personal data means actions aimed at disclosing personal data to a particular person or a particular group of persons;
Dissemination of personal data means any action aimed at disclosing personal data to an indefinite group of persons (the transfer of personal data) or at making personal data known to an unlimited number of persons, including publishing personal data in the media, placing it in information and telecommunications networks, or providing access to it in any other way;
Cross-border transfer of personal data means the transfer of personal data to a third country, that is, to a country outside the European Union and the European Economic Area;
Destruction of personal data means actions that result in personal data being irretrievably destroyed, such that the content of the personal data can no longer be restored in the personal data information system and/or that result in the destruction of the tangible media on which the personal data is stored.
3. List of data to be processed
The Controller may process the following personal data of the User:
surname, first name;
email address;
actual residential address and registered address of residence and/or place of stay.
The website also collects and processes anonymized data about visitors (including cookies) using internet statistics services (Facebook, Yandex Metrica, Google Analytics, and others).
The data referred to above is hereinafter referred to collectively in this Policy as Personal Data.
4. Purposes of personal data processing
The purposes of processing the User’s personal data are:
informing the User by sending emails;
concluding, performing, and terminating civil law contracts;
providing the User with access to the services, information, and/or materials available on the website.
The Controller is also entitled to send the User notifications about new products and services, special offers, and various events. The User can always opt out of receiving informational messages by sending an email to the Controller at support@fornex.com with the note "Refuse notifications about new products and services and special offers".
The Users’ anonymized data collected via internet statistics services is used to gather information about Users’ actions on the website and to improve the quality of the website and its content.
5. Legal basis for processing personal data
The Controller processes the User’s personal data only where the User completes and/or submits it themselves through the special forms on the fornex.com website. By completing the relevant forms and/or submitting their personal data to the Controller, the User consents to this Policy.
The Controller processes anonymized data about the User where this is permitted in the User’s browser settings (the saving of cookies and the use of JavaScript are enabled).
6. Procedure for collecting, storing, transferring, and otherwise processing personal data
The security of the personal data processed by the Controller is ensured by implementing the legal, organizational, and technical measures necessary to fully comply with the applicable data protection legislation.
The Controller ensures the safety of personal data and takes all possible measures to prevent access to personal data by unauthorized persons.
The User’s personal data will never, under any circumstances, be transferred to third parties, except where required to comply with applicable law.
If inaccuracies in personal data are identified, the User can update them independently by sending the Controller a notice at support@fornex.com with the note "Updating of personal data".
The period for processing personal data is unlimited. The User may withdraw their consent to the processing of personal data at any time by sending the Controller a notice by email at support@fornex.com with the note "Withdrawal of consent to the processing of personal data".
7. Instructions on complete removal of personal data
In order to completely delete personal data, the User shall log in to their account on the Controller’s website (https://fornex.com/), press "Tickets" (or paste https://fornex.com/my/tickets/ into the browser and hit enter), then press "Create ticket", after which a form will appear.
The User shall enter "Erase personal data" in the Subject field, skip the "Relates to" field, choose "High" in the Priority field, enter "Erase my personal data" in the last field of the form, and hit "Create".
The Controller will process the request within 1-2 hours and completely erase the personal data from its databases.
8. Cross-border transfer of personal data
Before carrying out a cross-border transfer of personal data, the Controller shall ensure that the third country to which the personal data is to be transferred provides adequate protection of the rights of data subjects.
A cross-border transfer of personal data to third countries that do not meet the above requirement may be carried out only if the data subject has given written consent to the cross-border transfer of their personal data and/or where it is necessary to perform a contract to which the data subject is a party.

The User may obtain any clarifications regarding the processing of their personal data by contacting the Controller by email at support@fornex.com.
This document will reflect any changes to the Controller’s personal data processing policy. The Policy is valid indefinitely until it is replaced with a new version.
